Topics for discussion at the Russian Arbitration Day 2014:

  • Amendments to the Russian legislation on arbitration courts have already provoked heated debates. At the Russian Arbitration Day 2014 it is planned to take a close look at the global changes and discuss to what extent the Russian reforms comply with them. In particular, Dominic Pellew, solicitor of the Supreme Court of England and Wales and partner of the London office of Dentons, will make a report “Russian Legislative Reforms in the Arbitration Field: the View of a Foreign Specialist.”
  • The legislation on arbitration and the arbitration rules at Vienna Economic Chamber have recently been amended in Austria. Are the Austrian amendments and the present-day legislative reforms in Russia similar? This will be the focus of the speech of Christoph Liebscher, partner of Vienna office of WolfTheiss, lecturer of the “international arbitration” course in the University of Salzburg.
  • In 2013 the International Dispute Resolution Center / the American Arbitration Association (IDRC/AAA) made a revolutionary amendment to its rules, that is, the appeal procedure against an arbitral award was introduced. Though this procedure is applied in the International Center for Settlement of Investment Disputes (ICSID) in Washington, IDRC/AAA are among the first to introduce similar procedure for commercial arbitration. Will it be a new trend? Should Russian arbitrations follow this example? The report will be given by the co-author of the said amendments to the rules – James Hosking, one of the partners-founders of Chaffetz Lindsey LLP law firm, the co-author of the Comments on IDRC/AAA rules — A Guide to the ICDR International Arbitration Rules (Oxford University Press, 2011), Associate Professor of the law department of the University of Pennsylvania.

27 – 28 February 2013, London – The second C5 forum on "International disputes resolution involving Russian and CIS companies"

Increasing engagement of Russia and CIS countries in world trade and international business activities is bringing more and more disputes to the scene of international arbitration and litigation in foreign jurisdictions. For instance, In London, famous for its legal services, it is estimated that over half of the current cases in the English Commercial Court have a connection to Russia or other CIS states.

These disputes are notorious not only for the vast sizes of the claims but also for the complicated case strategies resulting from shortcomings of the regional judicial systems, high number of mandatory norms in legislation and difficulties with enforcement of the rewards in Russia and CIS. Often inconsistent information from the clients makes matters even more complicated.

Companies seeking legal safeguards for their international business activities, along with their external legal advisers, have to know all options available for dispute resolution and the best case strategies, which provide not only victory and reward but also achieve it with the greatest efficiency - time- and money-wise.

The second C5 forum on "International disputes resolution involving Russian and CIS companies" will address practical issues faced by in-house counsels and external legal advisers involved in cross-border dispute resolution. It will also give you access to leading practitioners that will present recent experiences in resolving disputes and discuss the specific issues associated with cases involving Russian and CIS companies

  • Arbitrability of international disputes with Russian/CIS parties
  • Enforcement of arbitral awards/foreign court decision implementation
  • National courts as an instrument for arbitration case strategy
  • FDI safe guards
  • Arbitration clause – choosing arbitration rules / institution
  • Funding of litigation/arbitration
  • Calculating damages
  • Developing anticorruption legislation and implications for dispute resolution

If you are unavailable on the conference dates, please note that this event will be broadcast via webinar after the event. Featuring full, unedited sessions, power-point presentations, Q&A and much more – Sign up now and ensure that missing the conference doesn’t mean missing out on the latest perspectives and critical information that you and your team need to navigate the complex Biosimilars landscape.
